Unless otherwise specified, the relationship between AW365 Ltd. and its Users is governed exclusively by these Terms and Conditions, which are considered read and accepted by the User. If you do not fully agree with these terms and conditions, please refrain from using the Site.

 

When purchasing products on this Site, you may encounter additional guidelines, rules, and policies specific to those services and products. These are incorporated by reference and will apply to your use of the Site.

These Terms govern your use of our website and any purchases made.

 

 

1. Content Accuracy


AW365 Ltd. strives to keep the information on the Site up to date. However, we cannot guarantee the complete absence of errors. Information and other materials on this Site may contain inaccuracies or typographical errors. The weights, dimensions, and volumes of products are approximate. We have made reasonable efforts to ensure product information is accurate and to display colors as accurately as possible, but we cannot guarantee your screen's display will reflect the product color upon delivery. Information on the Site may change periodically without notice. AW365 Ltd. reserves the right to modify the Site at any time at its discretion. We do not guarantee that the functions on the Site or its content will be uninterrupted or error-free, that defects will be corrected, or that the Site or its server is free of viruses or harmful components. AW365 Ltd. is not liable for the use of the Site, including any content or errors.

Each product is sold subject to its description, which includes specific conditions such as estimated delivery dates and times, warranties, after-sales service, and guarantees.

2. Account Creation and Use

 

- To order, you can either create an Account or checkout as a guest, ensuring all provided information is accurate and updated.


- AW365 Ltd. sells products to adults, and those under 16 may use the Site only with parental or guardian involvement.


- Your Account is for personal use only and must be kept confidential.


- We may close your Account at any time, with any balance refunded.


- If we send a payment to your bank account and it is refused and you do not supply us with an alternative bank account within 28 days of us asking you, we may keep the monies in that account to offset the expenses we have incurred and you will be entitled to nothing.


- In cases of suspected fraud, we may withhold any account balance and report those actions to the Police.


- Only one Account per user is permitted and you will not give your username or password to anyone else.


- You must log off when you exit the Account.


- You warrant that you are a consumer and are purchasing any service or product as a consumer and not for sale or supply to any third party.


- If we earn any commission on any transaction in which we are involved or any interest on the money deposited in your Account we may keep that commission and/or interest.


- You can cancel your Account with us at any time; all you need to do is to email us at [email protected].

 

3.Pricing

 


The price of the products at the time of order confirmation, as displayed on the Site, will be the price you are charged. This price will be reiterated in the email confirmation of your order. All prices are listed in GBP (£) and include VAT. All the extra charges are not included in the display price on the product page.

 


In the event of a pricing error for the products you have ordered or in the delivery charge, we will notify you promptly. You will have the option to either reconfirm your order at the correct price or cancel your order. Should you choose to cancel before the item is shipped, we will issue a full refund for the amount charged to your account.

 

 

4.Ordering Procedure


4.1 The ordering process consists of the following steps:


-Order Selection: Select your desired products and choose your delivery method.

 

-Address and Payment: Enter your delivery and billing addresses along with payment information.

 

-Terms and Conditions: Accept the Terms and Conditions.

 

-Review and Submit: Review your order details, including total price and shipping charges, before submitting.

 

-Order Confirmation: After submission, you will receive an email confirming receipt of your order and, if paying by credit card, an email with your payment status.

 

-Order Processing: Upon shipping, a notification email ("Shipping Notification Email") will be sent. All orders depend on product availability at the time of dispatch. Purchasing from AW365 Ltd. and selling to AW365 Ltd. are treated as separate transactions.

 

4.2 Payment

 

- AW365 Ltd. accepts payments by a valid credit card, debit card, or AW365 Ltd. store credit. Payment must be made in GBP (£), UDS ($) or EUR (€). Please refer to the Privacy Policy posted on the Site for further information regarding internet fraud and secure payment. 

 

- AW365 Ltd. retains title to the sold goods until we have received full payment of the price and shipping charges, and possible late payment interests and/or indemnities.


5. Sales and Cancellation Policy


5.1 Invitation to Treat: Information on our Website is an invitation to treat and not an offer. Your order is a binding offer to purchase products.

 

5.2 Acceptance: The sale is binding once AW365 Ltd. accepts your order. An email will notify you of our acceptance.

 

5.3 Rejection and Cancellation: AW365 Ltd. reserves the right to refuse or cancel orders for reasons including but not limited to:

 

-Product unavailability.

 

-Incorrect or unverifiable billing information.

 

-Orders flagged by security systems.

 

-Delays in bank transfer payments.

 

-Suspected underage or reseller purchases.

 

-Pricing errors.

 

-Delivery issues.

 

-Force majeure events.

 

5.4 Order Amendments: You may amend your order until we accept it.

 

5.5 Price Changes: If prices change between order placement and processing, you will be informed and given the option to cancel.

 

5.6 Contract Confirmation: Terms of the agreement and product details will be confirmed via email per Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013.

 

5.7 Ownership Transfer: Ownership transfers upon full payment.

 

5.8 Order Rejection: If we reject your order, a full refund will be issued within 14 days using your original payment method.

 

5.9 Order Cancellation: We reserve the right to cancel your order for any reason and will refund any payments made.

 

5.10 Product Supply Issues: If we cannot supply a product after order acceptance, we will refund your payment, discharging any further liability.

5.12 International customers:


5.12.1 We are not responsible for import duties and taxes arising on the supply of our services outside the United Kingdom and we will make no calculations or estimates in this regard. Customers are also responsible for resolving any issues that arise with their local customs, including completing necessary declarations.


5.12.2 You agree that you are an importer of record and that you will ensure that your use of any Product we supply is in full compliance with the laws of the country in which you wish to use it.


5.12.3 You warrant the use of any Product is legal in the jurisdiction in which you intend to use it and will indemnify us against all losses we sustain in the event that you breach this warranty.

 

 

6. Delivery

 

6.1 Delivery times are estimates and not guaranteed.

 

6.2 We strongly advise all customers to pay an additional delivery insurance fee to insure their product(s) whilst in transit. Optional shipping insurance will be available to all customers at checkout. Please note that by choosing not to insure your product, you will be responsible for any delivery damages, faults and/or losses. Kindly note that insurance fees are non-refundable. Furthermore, all insurance claims related to the shipment must adhere to specific timelines as established by the shipping company for processing your claim. Should you have any concerns regarding your shipment, it is essential that you promptly adhere to the procedures outlined in General Terms to report the issue to us without delay.

 

6.3 We can deliver only to the address, and in the manner you have specified when ordering and you may collect the Product from our premises by prior appointment.

 

6.4 If we offer free delivery on any Product; delivery will be by the method we choose.

 

6.5 Please ensure that you provide us with the correct delivery address and contact details as any mistakes cannot be rectified and/or compensated for once we have shipped your order.

 

6.6 If the product is returned to us for any reason, the customer will be responsible for paying the additional shipping costs.

 

6.7 Products that AW365 LTD consents or directs in writing to be returned should be returned by the Customer to AW365 LTD or any other destination specified by AW365 LTD.

 

6.8 Customers requesting a refund, which is subject to our approval, must ensure the returned item reaches us with the original packaging with AW365 Ltd tag unaltered and the product unused. To arrange for a return, you must inform us by email with the date of your order, the order number, product information, your name and address at [email protected] as soon as possible and within 24 hours of receiving your delivery. We may request photographic evidence of any issue. The Product should not be returned until you have received further instructions from us.


6.9 A refund is not possible if the product has been used or the AW365 insurance tag is damaged/ broken.


6.10 For faulty goods or goods being returned due to our error, we will provide the customer with appropriate remedies, which could include a refund or a replacement, in line with our terms and conditions.

 

6.11 All returns should be sent to the address we specify when we acknowledge your request – we are happy to arrange carriage (at your cost).

 

6.12 This policy ensures the highest standards of product quality and industry procedure. Thus, refunds or replacements are not available if they do not adhere to our strict refund criteria. 

 

6.13 Any failure to comply with these provisions may mean that your right to a refund is lost.

 

7. Handling of User Suggestions

 

- Submitting suggestions to AW365 Ltd. regarding new products, features, or processes does not establish a confidential relationship, nor does it oblige AW365 Ltd. to treat such submissions as confidential. AW365 Ltd. makes no commitment to maintain the confidentiality of these submissions.

 


- AW365 Ltd. reserves the right to retain any submitted materials, make copies, and keep them in its files.

 


- AW365 Ltd. assumes no obligation from the receipt or examination of a submission unless a formal written agreement is signed by both parties. Any obligations of AW365 Ltd. will be explicitly outlined in such an agreement.

 


8. Governing Law and Dispute Resolution

 

Any dispute related to the validity, interpretation, or execution of these Terms and Conditions shall be governed exclusively by the laws of England and resolved in the English courts. This provision does not affect your statutory rights. In case of a dispute concerning the use of the Site, the User agrees that electronic evidence (e.g., emails, backups) is admissible as valid evidence.

 

If any part of these Terms and Conditions is declared null and void or inapplicable, the remaining terms and conditions will continue to be valid, and the portion declared null and void will still apply within the limits set by law.

 

9. Entire Agreement

 

These Terms and Conditions replace all prior agreements and understandings between AW365 Ltd. and the User.
