Welcome to the AW365 Ltd. website (referred to as the "Site"). Please take a moment to carefully read these terms and conditions. Unless otherwise specified, the relationship between AW365 Ltd. and its Users is governed exclusively by these Terms and Conditions, which are considered read and accepted by the User. If you do not fully agree with these terms and conditions, please refrain from using the Site.

 

AW365 Ltd. reserves the right to amend the Terms and Conditions by posting changes on the Site. Your continued use of the Site after such changes are posted will constitute your acceptance of the revised terms.

 

These Terms and Conditions (hereinafter referred to as "Terms") govern the use of the AW365 Luxury Brand New and Pre-Owned Items Service (hereinafter referred to as the "Service") provided by AW365 Limited (hereinafter referred to as "we," "us," or "our").

Agreement

 

These Terms govern your use of our website and any purchases made.

 

Offer, Quote and Acceptance

 

1.1 Initial quotes provided in person, by email, or over the phone are not final offers and may be changed or withdrawn by AW365 at any time for any reason.

 

1.2 AW365 reserves the right to decline providing a quote on any item or to any customer without explanation.

 

1.3 After evaluating the luxury pre-owned items, we will send the customer an email with a fixed offer price, which is non-negotiable. The value offered by AW365 may be adjusted upon receipt of the items based on their condition, quantity, or our business needs.

 

1.4 Customers must either drop off the item at our office or arrange for collection through our trusted couriers at our expense. By using our collection service, the customer agrees that the quote is accepted. Upon acceptance of the offer price, customers will need to provide collection information.

 

1.5 Customers have seven days from the date of the offer email to accept or reject the offer price. If the offer is not accepted within seven days, it will be automatically withdrawn, and the customer must resubmit the item to proceed.

 

1.6 Customers must prepare the luxury pre-owned item for collection according to our instructions.

 

1.7 Customers are responsible for ensuring that the luxury items and all associated materials, including specific accessories, are included in the package. Failure to include any items mentioned in the initial offer or sending items that do not match the original description may result in a revised offer.

 

1.8 When selling your bag to us, please do not include any additional items that were not part of the original purchase, such as bag liners or extra embellishments. We will not be liable for these extra items, and your cooperation in adhering to this policy is appreciated for a smooth transaction.

 

1.9 Our resale service allows customers to maximize earnings without selling directly to AW365. Once items are verified and accepted, they can be listed on our site without upfront fees. Listing fees and relevant costs apply only upon a successful sale. By using this service, customers agree to these terms and conditions.

 

2. Inspection, Authentication & Valuation Testing

 

2.1 Once the customer accepts our quote and sends us their items, the purchase is considered final.

 

2.2 Upon receiving a luxury pre-owned item, we will inspect it in collaboration with our partner company to verify that it matches the description, is in suitable condition, and is authentic. AW365 reserves the right to share photographs of the customer's products with a third-party company.

 

2.3 AW365 accepts only fully authentic items. Our team of experts, with extensive experience in luxury fashion and the brands we carry, will conduct a thorough authentication process. If an item is identified as counterfeit, we will forward it to the appropriate authority and will not return it to you. All inauthentic items will be handed over to the required authority or destroyed seven days after notification. If you wish to have the item returned, a fee of up to £100 plus delivery charges will apply, payable before the item is sent back. We assume no responsibility for any loss or damage during the return delivery process. Please consider this policy when using our services.

 

2.4 If the luxury item passes inspection, we will send a purchase confirmation email with relevant information. If, after physical inspection, the item is given a lower price or fails to meet our authenticity standards, we will email the customer with the option to accept the new price or have the item returned to their registered address.

 

2.5 While AW365 will make every effort to care for items left by customers for authentication and valuation, these items are left at the customer's own risk. AW365 reserves the right to transfer the customer's products internally between AW365 locations for authentication purposes.

 

2.6 The time required to complete our assessment can vary from 24 hours to a maximum of two weeks.

 

2.7 The duration of processing and cleaning/restorative work varies from two to fourteen days, depending on the type of service required.

 

2.8 AW365 does not guarantee the shipment, posting, or delivery of abandoned or rejected products. Customers may need to collect these items in person or arrange for a courier at their own expense. Alternatively, AW365 can arrange for a courier to return the items, with any associated costs being the responsibility of the customer.

 

2.9 Abandoned or rejected products will only be released to the original customer.

 

2.10 In extreme situations, AW365 reserves the right to send rejected or abandoned items back to the customer's registered address. AW365 is not liable for incorrect addresses or items lost in transit.

 

3. Processing and Purchase

 

3.1 Customers submitting an item for sale at AW365 must ensure that the item is free from any financial obligations, theft, and is authenticated. Should the product later be found to be stolen, encumbered, or counterfeit, AW365 reserves the right to take both civil and criminal legal action against the customer.

 

3.2 Payments issued by AW365 are based on the information provided by the customer. AW365 is not liable for payments sent to incorrect or non-existent accounts due to inaccurate details provided by the customer.

 

3.3 AW365 is not responsible for communication errors resulting from inaccurate or incomplete contact information. Customers must ensure they can receive emails from AW365, and we are not liable for any emails that are blocked or filtered as spam. If inaccurate or outdated information is provided, AW365 is not responsible for misapplied payments or payments sent to the wrong address.

 

3.4 Any physical paperwork sent to us, including receipts that contain personal data, may be destroyed. We advise customers not to send receipts or paperwork containing personal or financial details with their items.

 

4. Offer Cancellation

 

4.1 All offers from AW365 to purchase submitted items are indicative and non-binding. We retain the right, at our sole discretion and at any time, to cancel any offer or consignment agreement. Should you accept an offer but then decide to withdraw before the title of property is transferred, we may deny your cancellation request. If the cancellation is approved, a fee of £35 will be applied. This fee may increase based on the stage of the buying process, ranging from £50 to £100, in addition to any costs for cleaning and restorative work carried out on your item and its full retail value.

 

4.2 If you wish to remove your listed item from our platform and have it shipped back to you, relevant costs will apply, including cancellation and shipping fees. You are responsible for paying these fees in full before the item(s) can be shipped back to you.

 

5. Consignment Terms

 

5.1 Details of your specific consignment terms will be emailed to you as part of your assessment. Until we receive your acceptance, your item(s) will remain under assessment, and the assessment terms and conditions will apply.

 

5.2 If your consignment agreement ends and you have not notified us of your intention to collect your item(s), the agreement will automatically renew for a 14-day term. If either party intends not to renew the agreement, you will be notified to collect your item(s), or we can arrange delivery, which may incur a delivery charge.

 

5.3 Failure to respond to our correspondence regarding your item(s) for over one month may result in your item(s) being disposed of, donated, or sold at a value determined by our team of experts, based on the most sustainable option.

 

6. Payments

 

6.1 Payments for clients who accept cash offers are made via direct bank transfer, not in cash. We will issue payment by bank transfer or as store credit with an invoice within seventy-two (72) hours following the purchase confirmation email. Your item(s) become the sole property of AW365 upon payment. All payments will be made in GBP (£); other currencies may be possible upon request.

 

6.2 Clients are contacted directly to provide their account details. It is the client's responsibility to ensure these details are correct. AW365 is not liable for payments made to incorrect accounts if incorrect details are provided. All account details must be submitted in written format by the customer or from the email address registered against the item/reference number/Invoice.

 

7. Restorative Work

 

AW365 can carry out any necessary cleaning and restorative work on your item(s) before it is made available for sale or at any point while listed for sale with us. AW365 reserves the right to increase the selling price of your item at its discretion without informing you. For consignment items, you will receive the agreed percentage as per your specific consignment terms, minus the cost of any repairs carried out.

 

8. Title of Property

 

8.1 Consignment items remain the customer’s property until sold, defined by:


   - Sale to AW365.


   - Sale by AW365 to a customer without return within the specified period.


   - Loss, theft, damage, or destruction while in AW365’s possession.

 

9. Personal Shopper Service

 

We offer a personal shopper service for purchasing new luxury items. A commission fee applies, with prior notification of these fees provided to customers.

 

10. Advertising and Social Media

 

By accepting an offer, customers grant AW365 full consent to use their items in advertising campaigns, social media, or competition giveaways. AW365 will determine which items are used for these purposes.

AW365 reserves the right to modify these terms and conditions at any time without prior notice.
